Copyright and DMCA Policy

1. Purpose; who we are

BTR Solutions, LLC (“TCGHawk,” “we,” “us”) respects intellectual property rights. This Copyright and DMCA Policy explains how rights holders and users can report alleged copyright infringement on our websites, applications, and related services (collectively, the “Services”), and how we may respond under the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and related law.

This Policy supplements our Terms of Service (“Terms”). Capitalized terms not defined here have the meanings in the Terms. In case of conflict, the Terms control for your use of the Services; this Policy controls for copyright notice and takedown procedures described below.

We do not provide legal advice. If you are unsure whether content infringes your rights or whether a takedown or counter-notice is appropriate, consult an attorney.

2. What content this Policy covers

This Policy applies to material stored or displayed at the direction of users through the Services, including without limitation:

Licensed catalog data. The Services may also display product information, identifiers, and images obtained from third-party sources under separate licenses or terms (for example, data resolved from Scryfall for Magic: The Gathering or image URLs from TCGPlayer or other partners). That material is not “user-submitted” for purposes of Section 4 below. If you believe our display of licensed or imported catalog material infringes your rights, contact us under Section 3 and describe the specific URLs and works; we will review in light of our agreements with data providers and applicable law.

Before publication: register this designated agent with the U.S. Copyright Office (copyright.gov/dmca-directory) and replace this note with the registration number and public directory link.

Do not send DMCA notices to general support or security inboxes unless we direct you to do so; misaddressed notices may delay our response.

4. How to submit a DMCA takedown notice

If you are a rights holder (or authorized to act on behalf of one) and believe that material on the Services infringes your copyright, you may send a written DMCA takedown notice to our designated agent. To be effective under 17 U.S.C. § 512(c)(3), your notice should include all of the following:

1. Physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

2. Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).

3. Identification of the material you claim is infringing, with enough detail for us to locate it (for example, specific URLs on TCGHawk, account or listing identifiers, catalog item IDs, and screenshots if helpful).

4. Your contact information, including your name, mailing address, telephone number, and email address.

5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement, under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or authorized to act on the owner’s behalf.

We may request additional information to process your notice. We may forward your notice (including your contact information) to the user who posted the material, as permitted by law.

Misrepresentations. Knowingly submitting a false or materially misleading takedown notice may expose you to liability under 17 U.S.C. § 512(f) and other law.

5. How we respond to takedown notices

When we receive a notice that appears to comply with Section 4, we may:

We are not obligated to remove material if a notice is incomplete or if we reasonably determine the notice does not meet legal requirements. We may decline to remove material we reasonably believe is not infringing, is licensed, or is protected by an applicable exception—without waiving any defense available to us.

We do not adjudicate copyright ownership disputes. If you and another user disagree, you may need to resolve the matter directly or in court (subject to the Terms, including arbitration where applicable).

6. Counter-notification (restoration request)

If your material was removed or disabled because of a DMCA notice and you believe the removal was mistaken or that you have the right to post the material, you may send a counter-notification to our designated agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification should include:

1. Your physical or electronic signature.

2. Identification of the material that was removed or disabled and the location where it appeared before removal (for example, URLs and identifiers).

3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which TCGHawk may be found), and that you will accept service of process from the person who submitted the original DMCA notice or an agent of that person.

5. Any other information required by applicable law.

Misrepresentations. Knowingly submitting a false counter-notification may expose you to liability under 17 U.S.C. § 512(f).

If we receive a counter-notification that appears compliant, we may forward it to the original complainant. If the complainant does not notify us within the period specified in 17 U.S.C. § 512(g)(2)(C) that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the material in our discretion, consistent with law and the Terms.

7. Repeat infringer policy

In accordance with the Terms and applicable law, we maintain a policy for repeat infringers. We may suspend or terminate accounts (or restrict upload, listing, or contribution features) for users who repeatedly upload or share material that we remove or disable in response to valid copyright complaints, or who we reasonably believe are repeat violators of intellectual property rights.

Factors we may consider include the number of valid notices, severity of infringement, user history, and good-faith counter-notifications. We are not required to provide advance notice where we reasonably believe immediate action is necessary for legal, security, or abuse reasons.

8. User responsibilities

If you submit images, listings, or other Customer Content, you are responsible for ensuring you have the rights necessary to use and license that content as described in the Terms. Do not upload official card scans, promotional art, or other third-party works unless you own the rights or have express permission from the rights holder.

Uploading infringing material may result in removal of content, loss of account access, and liability to rights holders and to TCGHawk under the Terms (including indemnity).

9. Trademarks and other rights

This Policy addresses copyright claims under the DMCA. It does not govern trademark, patent, publicity, or other claims. For those matters, contact legal@tcghawk.com with sufficient detail for us to evaluate.

10. Changes to this Policy

We may update this Policy by posting a revised version and updating the “Last updated” date. Material changes may be announced as described at https://tcghawk.com/terms.html or as required by law. The version in effect when you submit a notice or counter-notification applies unless law requires otherwise.
